カダフィ氏はいかに殺されたか その２

　カダフィ氏はいかに殺されたか。その話は先日のエントリー（参照）に書いた。それ以上書くこともないだろうと思っていたが、ツイッターで「これは米英が「国民評議会にカダフィを殺させた」って理解でいいですか？ 」と訊かれ、少し困惑した。それだけではどう返答していいものかわからない。
　そこで「どう思いますか？」と問い返した。答えは、「少なくとも殺さないようにした、とか。また、英米が拘束しないようにした、とも読めます。あくまでリビアの国内問題問で処理させる」とのことだった。それも、率直なところ、よくわからなかった。何か前提が欠落しているのではないかとも思った。
　いずれにせよ、カダフィ氏の殺害については、もう少し補足したほうがよいのかもしれないと思い至ったので、もう少し書いておこう。話のネタはスレートの「Muammar Qaddafi should not have been killed but sent to stand trial in The Hague」（参照）である。今週の日本版ニューズウィークも取りあげていた。
　話は単純極まる。なぜ、カダフィ氏は裁判にかけられなかったのか？　そのことにはどういう意味があるのか？ この2点の疑問にどう答えるかである。
　記者のクリストファー・ヒッチェンズ（Christopher Hitchens）は冒頭、リビア問題に関わるフランス有力者にカダフィ氏の国際裁判を求めるメールを書いたと記す。

Simple enough? It is some time since the International Criminal Court in The Hague has announced itself ready and open for business in the matter of Libya.

難しいとでも？　ハーグの国際刑事裁判所は、リビア問題を扱う用意があり、作業を開始すると発表してからそれなりに時が経過している。

But now Muammar Qaddafi is dead, as reportedly is one of his sons, Mutassim, and not a word has been heard about the legality or propriety of the business.

ところが現状、カダフィ氏は死に、その息子の一人、ムアタシムもが死んでいるにもかかわらず、この所業の合法性とその意味合いについての発言は聞こえてこない。

No Libyan spokesman even alluded to the court in their announcements of the dictator’s ugly demise.

リビア広報者は、独裁者の醜悪な死去の発表に際し、司法について仄めかしさえしなかった。

The president of the United States spoke as if the option of an arraignment had never even come up.

米国大統領は、罪状認否の選択肢などなきがごとく語っていた。

In this, he was seconded by his secretary of state, who was fresh from a visit to Libya but confined herself to various breezy remarks, one of them to the effect that it would aid the transition if Qaddafi was to be killed.

この件では米国国務長官も大統領と同様だった。リビア訪問を終えたばかりのクリントン国務長官は、カダフィが殺害されれば政権移行のタシになるだろうといった、脳天気なことしか言わなかった。

British Prime Minister David Cameron, who did find time to mention the international victims of Qaddafi’s years of terror, likewise omitted to mention the option of a trial.

デイビッド・キャメロン英国首相は、カダフィによるテロ時代の犠牲者が各国に及んだことを言及しつつも、裁判という選択について言及しないのは同様だった。

　リビアもその支援国も誰も、国際司法のことを言わなかったのである。
　忘れていた？　まさか。これはどう見ても、国際司法でカダフィ氏を裁く気なんかなかったと見るほうが妥当だ。ヒッチェンズ記者がこう思うのも頷ける。

Among other things, this tacit agreement persuades me that no general instruction was ever issued to the forces closing in on Qaddafi in his hometown of Sirte.

なによりこの黙約によって、基本方針のある命令などカダフィの故郷シルトでの追討部隊にまったく発せられていないと私は納得した。

Nothing to the effect of: Kill him if you absolutely must, but try and put him under arrest and have him (and others named, whether family or otherwise) transferred to the Netherlands.

「やむを得なければ殺害するとしても、出来る限り、彼や彼の家族などの関係者を逮捕し、ハーグの国際刑事裁判所に移送せよ」といった命令はなかったのだ。

At any rate, it seems certain that even if any such order was promulgated, it was not very forcefully.

そうした命令があったとしても、強制力はなかった。

　生きたまま逮捕できたはずであった。

But Qaddafi at the time of his death was wounded and out of action and at the head of a small group of terrified riff-raff. He was unable to offer any further resistance.

死期迫るカダフィは負傷し、動けず、怯えた下っ端を率いているだけだった。彼はそれ以上の抵抗はできかった。

And all the positive results that I cited above could have been achieved by the simple expedient of taking him first to a hospital, then to a jail, and thence to the airport.

先述したような好ましい結果も、彼をまず病院に送ることで容易く得ることができたはずだ。それから牢に送り、空港へと移送もできた。

　国民評議会軍はそれができなかったと言うのだろうか。北大西洋条約機構(NATO)軍は関与してないとでも言うのだろうか。そうではないなら、これはどういう事態なのか。

But it will be a shame if the killing of the Qaddafis continues and an insult if the summons to The Hague continues to be ignored.

カダフィ家の殺害が続くならそれは恥となるし、ハーグの国際刑事裁判所へのの出廷命令が無視されるなら、侮辱行為となるだろう。

　カダフィ氏の殺害は、国際社会が無法そのものであることを示している。
　それは、私たちの恥でもあるし、法への侮辱でもあり、つまりは、正義への愚弄そのものである。
